Blasts — Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the Blasts browser extension, the Blasts website (blasts.app), or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Tips Marketing Services, Corp ("we," "us," or "our"), a New Jersey corporation.

2. Description of Service

Blasts is a screen-to-screen messaging platform that delivers opt-in alerts and notifications directly to your browser. The Service includes:

Screen Blasts — Rich visual alerts from senders you have explicitly opted in to receive.
Voice Mailbox — Optional inbound voicemail with transcription for business users.
FIND ME Relay — Optional forwarding of alerts to your email, phone, or webhook.
Gmail integration (optional) — With your Google OAuth consent, the Service can place your opted-in Blasts into your own Gmail inbox (gmail.insert) and create a single "never send to Spam" safe-list filter for a sender you choose (gmail.settings.basic). Both are off by default, used only for the action you request, and never to read, send, modify, or delete your other email. See our Privacy Policy.
Email & Text Blasts with optional cloud sync — Send bulk Email and Text (SMS/MMS) campaigns from your own connected mailboxes and messaging providers. You may optionally sync those sending credentials to our secure cloud (off by default) so you can compose and send from the online portal (blasts.app/portal) on a phone or tablet. Synced credentials are encrypted in transit (TLS) and at rest (AES-256-GCM), decrypted only in memory during an active send, never exposed through any read interface, and can be erased at any time by turning the sync toggle off. 3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

4. Account & Registration

A valid email address is required for your Blasts inbox.
You are responsible for maintaining the confidentiality of your credentials, machine ID, and pairing codes.
You agree to provide accurate information and to keep it current.
You are responsible for all activity that occurs under your account.

5. Permitted Use

You agree to use the Service only for lawful purposes. You shall not:

Send unsolicited messages or spam through Blasts.
Impersonate another person or entity.
Transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Attempt to reverse-engineer, decompile, or tamper with the extension or its servers.
Use the Service to violate any applicable law, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or state consumer protection statutes.
Circumvent rate limits, licensing controls, or credit-based metering.

6. Messaging & Communications

Opt-in Required. All Blasts are sent to recipients who have explicitly opted in by accepting a pairing code or subscribing to a sender. Recipients may unsubscribe, block senders, or set quiet hours at any time from the extension settings.

SMS & Voice (Twilio Integration). Certain features use Twilio for voice calls and SMS. If you connect your own Twilio account via Twilio Connect, you are responsible for complying with Twilio's Terms of Service, A2P 10DLC registration requirements, and all applicable telecommunications regulations. Twilio bills your connected account directly for voice and SMS usage.

7. Credits & Payments

Certain premium features (FIND ME relay via SMS/webhook/voicemail) require prepaid credits.
Credits are non-refundable once consumed.
Email relay is always free. SMS, webhook, and voicemail relays debit one credit per relay.
We reserve the right to modify pricing with 30 days' notice.

8. Intellectual Property

All content, code, trademarks, and intellectual property associated with the Service are owned by Tips Marketing Services, Corp or its licensors. You retain ownership of content you create and send through Blasts. By sending content through the Service, you grant us a limited, non-exclusive license to transmit, store, and deliver that content to intended recipients.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. We do not sell your data, do not use tracking pixels, and do not inject analytics into your browsing. See the Privacy Policy for complete details on data collection, storage, and use.

10. Third-Party Services

The Service may integrate with third-party platforms including:

Twilio — Voice and SMS infrastructure (customer-owned accounts via Twilio Connect).
Stripe — Payment processing for licensing and credits.

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of any third-party service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Tips Marketing Services, Corp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Tips Marketing Services, Corp, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using the Service at any time by uninstalling the extension and deleting your account.
We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if required by law.
Upon termination, your right to use the Service ceases immediately. Cached data on your device may persist until you clear it.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated via the extension or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in the State of New Jersey.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
